A disturbing home invasion in Kalgoorlie-Boulder has left a community reeling, with the West Australian Police Commissioner announcing that there’s not enough evidence to charge the homeowner involved in the incident that led to the death of 20-year-old Tyrone Smith.
What Happened
On November 29 last year, Tyrone Smith suffered fatal injuries during a confrontation at a property in Kalgoorlie-Boulder, about 600 kilometers east of Perth.
Police allege that Mr. Smith was armed with a machete when he broke into the home around 10:15 am.
The homeowner, who was with his wife and child, confronted Mr. Smith, leading to an altercation that left both men seriously injured.
Mr. Smith was flown to Royal Perth Hospital, where he later died due to his injuries.
Family’s Grief and Demand for Justice
The family of Tyrone Smith is seeking answers and justice for their loved one.
Mr. Smith’s mother, Kathleen O’Loughlin, expressed her devastation and frustration with the investigation, stating that the family has only received “piecemeal disclosures” about what happened in the house.
She believes that the police have not done their job properly and is calling for a better outcome for the family.
‘Evidence is Not There’
Police Commissioner Col Blanch described the case as “unpleasant” for everyone involved and explained that the Major Crime Squad had extensively investigated the incident.
However, he stated that there was no real prospect of conviction due to the lack of evidence.
“There are defences to the way you act inside your house if you believe you are under threat,” Commissioner Blanch said.
“We have to assess whether there’s a reasonable prospect of conviction, whether the evidence is there for the charges. Simply, the evidence is not there.”
Next Steps
The family’s hope for answers now rests on the potential for WA’s Coroner’s Court to probe the incident and investigation.
The Coroner’s Court may be able to provide more insight into the events surrounding Tyrone Smith’s death and help the family find the justice they are seeking.
