According to eyewitnesses, Ms Wellington allegedly assaulted Mr Perry, causing him to fall and suffer a serious head injury. Mr Perry was taken to St George Hospital in a critical condition, but tragically died less than a month later on April 13.
Ms Wellington was originally charged with reckless grievous bodily harm, but after Mr Perry’s death, she was served with a court attendance notice detailing a second charge of assault occasioning death.
In Nowra Local Court, a lawyer representing Ms Wellington attempted to have the matter heard without her being present, but Judge Julie Zaki insisted that she appear in person.
